These Terms & Conditions (the "Terms") govern your use of this website (the "Site") operated by DSNMRK, also doing business as Design Marketing ("DSNMRK", "we", "us" or "our"). By accessing or using the Site you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

1. Who We Are

DSNMRK is a digital marketing and web development agency. We provide services including website design and development, hosting and maintenance, AI search and search engine optimization, marketing automation, email marketing, paid advertising, social media and content marketing, and custom web applications.

4. Client Names, Logos and Case Studies

Client names, logos, trademarks and images that appear on the Site belong to their respective owners and are used to describe work DSNMRK has performed for those clients. Their appearance does not imply endorsement of DSNMRK by the client, or of any third party by DSNMRK. Results described in our case studies reflect the experience of the specific client and project and are not a guarantee of similar results for any other business.

5. Services, Proposals and Agreements

Information about our services on the Site is provided for general information only and does not constitute an offer. Any services we provide are governed by a separate written proposal, statement of work or services agreement between DSNMRK and the client. In the event of a conflict between these Terms and a signed agreement, the signed agreement controls with respect to the services it covers.

Estimates, timelines and pricing discussed prior to a signed agreement are indicative only and may change based on the final scope of work.

6. Inquiries and Submissions

When you contact us or submit a form on the Site, you agree that the information you provide is accurate and that we may use it to respond to your inquiry and, where you have consented, to send you marketing communications. Submitting an inquiry does not create a client relationship, and any ideas or materials you send us unsolicited are provided on a non-confidential basis.

Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100). Liability for services we provide to clients is governed by the applicable services agreement.

Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in that state, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy and any signed services agreement, constitute the entire agreement between you and DSNMRK regarding the Site.
